David Vassar

Mr. Vassar has been in the courtroom since his graduation from law school in 1991. He has a diverse range of experience, from criminal prosecutions in a District Attorney’s Office, to the litigation section at one of the largest law firms in Texas, to founding and managing partner of Nesbitt, Vassar & McCown. His litigation practice has included real estate litigation, small company breakups, structured settlement matters, collections and the defense of same, a wrongful death lawsuit, and contract litigation. He has handled several lawsuits involving temporary restraining orders and temporary injunctions and has presented seminars in those areas. Mr. Vassar is also proficient in contract drafting and review and business formation.

Business Dispute Litigation

Mr. Vassar has represented shareholders, LLC members and managers, partners and officers in a variety of matters relating to company disputes.

  • Represented President and Partner of local medical company in efforts to oust him from business. Court ordered immediate reinstatement.
  • Represented President of local technology company in efforts by outsider lender to dilute his interest in company.
  • Secured injunction against partner prohibiting conversion of assets of foreign mechanical company.

Real Estate Litigation

Mr. Vassar has extensive experience in real estate law, both in contract formation and interpretation as well as litigation.

  • Represented several clients in litigation over sales of real estate. Received summary judgment on behalf of a defendant to one such lawsuit.
  • Represented numerous property owners in forcible entry and detainer lawsuits to recover property from tenants and others.
  • Represented local real estate developer in partnership dispute over resort property.

Commercial Litigation

Mr. Vassar has broad experience in commercial and contract litigation.

  • After trial, won verdict returning California start-up company’s funds deposited with Texas service provider as well as attorneys’ fees and interest; successfully garnished defendant’s funds days after trial in satisfaction of judgment.
  • Represented local plumbing company in various commercial and real estate disputes.
  • Represented local Doctor in contract dispute relating to medical trial business.

Structured Settlement Law

Mr. Vassar's work in the area of structured settlement law is extensive and has continued for nearly two decades.

  • Prior to advent of state statutes allowing for sale of structured settlement payments, successfully sued insurance companies which claimed anti-assignment provisions prevented such sales.
  • Has appeared in at least 50 Texas counties in transfer actions under Texas structured settlement protection act.
  • Counsel in many commercial disputes in state and federal courts and arbitration regarding structured settlement matters.
